Article 1 Scope of Application
Accommodation contracts and related agreements entered into by this hotel with guests shall be in accordance with the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be in accordance with laws and regulations or generally established customs.
In the event that this hotel agrees to a special agreement to the extent that it does not violate laws, regulations and customs, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.
Article 2 Application for Accommodation Contract
A person who wishes to apply for a contract of accommodation at this hotel is requested to provide the following information to this hotel.
- Name of guests Gender and number of persons
- Date of stay and estimated time of arrival
- Accommodation charge (in principle, according to Appendix 1)
- Other matters deemed necessary by the hotel
In the event that a guest requests to continue his/her stay beyond the date of stay as stipulated in the preceding paragraph (2) during his/her stay, this hotel shall treat such request as a new application for a contract of accommodation at the time such request is made. (2) In the event that the person who has made the request for accommodation has not received the hotel’s notification of the guest’s name, address, telephone number, etc.
When a guest is requested to submit a list of guests who have stayed at the accommodation, the guest shall submit the list immediately, even after the accommodation contract has been concluded.
Article 3 Establishment of Accommodation Contract, etc.
The accommodation contract shall be concluded when this hotel accepts the application as described in the preceding article. However, this shall not apply when this hotel proves that it did not accept the application. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by this hotel shall be paid by the date designated by this hotel within the limit of the accommodation charge for the period of stay (3 days if the period exceeds 3 days). If payment is not made by the date designated by this hotel, the accommodation contract shall cease to be effective. The hotel will not accept any reservation unless this hotel has notified the guest to that effect when specifying the date for payment of the application fee.
The deposit shall first be applied to the room charge ultimately payable by the guest, and in the event that the provisions of Articles 6 and 17 apply, the deposit shall be applied in the order of cancellation charge followed by compensation, and any remaining amount shall be returned upon payment of the charges pursuant to Article 12.
In the event that this hotel has presented or announced an incorrect room charge on the Internet or by telephone, etc., and even in the event that an application for or acceptance of a room contract has been made based on said room charge, if said room charge is significantly lower than the dates preceding or following the date of the incorrect room charge, then said room contract shall be deemed to be an acceptance due to a civil law error, unless the reason (“limited” or “special” etc.) for the significantly lower room charge is indicated. Unless there is an indication of the reason for the significantly lower rate (“limited”, “special”, etc.), it will be deemed to be an acceptance due to a mistake under the Civil Code, and the accommodation contract concerned will be deemed invalid and a notice to that effect will be promptly given.
Article 4: Special clause that the application fee is not required to be paid
Notwithstanding the provisions of the preceding Article, the Hotel may accept a special agreement whereby the payment of the application fee under the preceding paragraph is not required after the conclusion of the contract.
In the event that this hotel does not request the payment of the application fee as stipulated in the preceding article or does not specify the date of payment of said application fee when accepting the application for the accommodation contract, it shall be treated as if the special agreement stipulated in the preceding paragraph had been complied with.
Article 5. Refusal to enter into an Accommodation Contract
In the following cases, this hotel may refuse to conclude a contract of accommodation or to allow guests to use the hotel’s facilities.
(i) When the application for accommodation is not in accordance with these terms and conditions

(iii) The person who intends to stay at the accommodation is not subject to the provisions of laws and regulations, public order, or good morals in connection with the accommodation.

Article 6 Guest’s Right to Cancel Contract
The guest may cancel the accommodation contract by notifying this hotel. In the event that the guest cancels all or part of the accommodation contract for reasons attributable to the guest (except in the event that this hotel has requested payment of the deposit pursuant to Article 3 and the guest cancels the accommodation contract prior to such payment)
A cancellation fee will be charged in accordance with the terms and conditions set forth in Appended Table 2. In the event that a cancellation charge other than those listed in Schedule 2 was defined at the time of the accommodation contract, the cancellation charge will be applied in accordance with the conditions at the time of the accommodation contract. However, in the event that this hotel has agreed to the special contract stipulated in Article 4, the cancellation fee shall be charged only when this hotel has notified the guest of his/her obligation to pay the cancellation fee in the event that he/she cancels the accommodation contract in accordance with such special contract.
In the event that the guest does not arrive at 20:00 on the day of the stay (or 2 hours after the arrival time if the guest has notified this hotel in advance of an arrival time after 20:00), this hotel may deem the accommodation contract to have been cancelled by the guest and dispose of the room.
Article 7 Right of the Hotel to Cancel the Contract
The hotel reserves the right to cancel the accommodation contract and the contract for the use of hotel facilities in the following cases
(i) When the guest fails to comply with the hotel’s accommodation agreement and the hotel’s rules of use.
(2) The guest’s conduct in connection with the stay is contrary to the provisions of laws and regulations, public order, or good morals.
(iii) When it is recognized that there is a likelihood of the person committing the said act or when it is recognized that the person has committed the said act.
(iii) When this hotel judges that the guest is unqualified to stay at the hotel due to lack of decorum, etc. (iv) When the guest fails to pay the room charge to this hotel,

Article 8 Accommodation Registration
Guests are requested to register the following items at the reception desk of the hotel on the day of their stay.
(i) Name, age, gender, occupation and address of the guest, and contact telephone number
(ii) For guests who do not have a domicile in Japan, nationality, passport number, place of entry and date of entry.
Departure date and scheduled departure time
(iv) Other matters deemed necessary by the hotel
If the guest intends to pay the charges as specified in Article 12 by a traveler’s check, room voucher, credit card, or any other method that can be substituted for currency, the guest shall present such check, voucher, or credit card in advance at the time of registration as specified in the preceding paragraph. In some cases, payment may be made in advance at the time of check-in.
In order to confirm the above items (1) to (4), we may ask you to present your driver’s license, my number card, residence card, passport, etc. In the event that the hotel is instructed to do so by government agencies or authorities, a copy of the personal identification documents will be made and kept in the hotel.
Article 9.
Guests may use the hotel’s guest rooms during the following hours. However, in the case of a consecutive stay, the guest may use the room for the entire day, except for the day of arrival and the day of departure.

Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of a room outside the hours specified in the preceding paragraph. In such cases, the following additional charges shall apply

Article 10 Compliance with Usage Rules
Guests shall follow the rules of use established by the hotel and posted in the hotel while in the hotel.
Article 11 Business Hours
The hours of operation of the hotel’s facilities, etc., will be posted at various locations, in booklets, and in-room information, etc. In addition, the hours of operation may be changed temporarily when necessary or unavoidable. In such cases, we will notify you by appropriate means.
Article 12 Payment of Charges
The breakdown of the charges payable by the guest shall be as listed in Appendix 1.
Payment of room charges, etc. shall be made in currency or by traveler’s check, room voucher, credit card, or other alternative method acceptable to this hotel, at the time of the guest’s departure or upon request by this hotel, at the reception and in the guest room.
Room charges shall apply even if the guest voluntarily does not stay in the room after the hotel has provided the room to the guest and made it available for his/her use.
Article 13 Liability of the Hotel
In the event that a guest is damaged intentionally or through negligence in the performance of the accommodation contract and related agreements, this hotel will compensate for such damage. However, this shall not apply if the damage is not caused by reasons attributable to this hotel. This hotel has Ryokan Liability Insurance.
Article 14. Treatment of cases in which the contracted room cannot be provided
If this hotel is unable to provide the guest with the contracted room, it will, with the consent of the guest, arrange other accommodations under the same conditions as far as possible.
If, notwithstanding the provisions of the preceding paragraph, this hotel is unable to arrange other accommodation, it will pay the guest a compensation fee equivalent to the cancellation fee, which will be applied to the amount of compensation for damages. However, if there is no reason attributable to this hotel for not being able to provide a guest room, no compensation fee will be paid.
Article 15 Handling of Deposited Property, etc.
(a) In the event of loss, damage, etc. to articles, cash, or valuables left at the reception by the guest, this hotel shall compensate for such damage, except in the case of force majeure. However, in the event that this hotel requires the guest to disclose the type and value of cash and valuables, and the guest fails to do so, this hotel shall compensate for the damage up to 100,000 yen.
(a) In the event that a guest brings into this hotel any articles, cash or valuables that have not been left at the reception, and that are lost, damaged or otherwise damaged due to the intentional or negligent act of this hotel, this hotel shall compensate for such damages. However, if the type and value of the items are not specified by the guest in advance, this hotel will compensate for the damage up to 30,000 yen, except in the case of willful misconduct or gross negligence on the part of this hotel.
Article 16 Custody of Luggage or Personal Effects of Guests
(a) When a guest’s baggage arrives at this hotel prior to his/her stay, the hotel will take responsibility for its safekeeping only if it is agreed by the hotel prior to arrival, and will deliver it to the guest at the reception or in the room when the guest checks in or after check-in.
(a) If a guest’s luggage or personal belongings are left at the hotel after the guest has checked out, the hotel will follow the instructions of the owner. However, if there are no instructions from the owner, or if the owner cannot be identified, the hotel will keep the property for 7 days from the date of discovery, and then report it to the nearest police station and follow the instructions of the police station. Food, beverages, cigarettes, magazines, daily consumables, and similar items will be disposed of immediately.
The hotel shall not be responsible for the custody of the guest’s baggage or personal belongings in the case of (i) above, and in the case of (ii) above, the hotel shall not be responsible for the custody of the guest’s baggage or personal belongings.
Article 17 Liability for Parking
When a guest uses the parking lot of this hotel, regardless of whether or not the key of the vehicle is deposited, the hotel rents the space to the guest and does not assume responsibility for the management of the vehicle. However, the Hotel shall be liable to compensate for any damage caused by its intentional or negligent management of the parking lot. When using the parking lot, please follow the signs and instructions given by the hotel staff. When parking, the engine and sound system must be turned off except when necessary. The above shall also apply to parking lots affiliated with the hotel.
Article 18 Liability of Guests
In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.
Article 19: Regulations on Guests’ Compensation
In the event that a guest of this hotel dies from a cause other than injury during his/her stay at this hotel, this hotel will carry out the matters stated in the hotel liability insurance and regulations that it has joined.
Article 20 Governing Law, Agreed Jurisdiction
Any disputes between this hotel and a guest regarding the accommodation contract shall be governed by the laws of Japan, and the district court or summary court having jurisdiction over the location of the head office of the company that manages or operates this hotel shall be the court of exclusive jurisdiction.
Article 21 Disclaimer
Use of computer communications from within the Hotel is at your own risk. We will not be liable for any damages incurred by you as a result of service interruption due to system failure, radio wave interference, power outage, or any other reason while using computer communications. In addition, if any damage is caused to the Company or a third party as a result of an act that the Company deems inappropriate for the use of computer communications, the Company shall be liable to compensate for such damage.
Article 22 Language
The Japanese language shall be used as the original text of these terms and conditions, and other languages shall be used as translations. The English translation is only to be used as a reference for the Japanese original, and the Japanese version shall take precedence over the English translation.

The % is the ratio of the cancellation fee to the room charge agreed upon at the time of application (including meals for packages with meals).
If the contracted number of days is shortened, a cancellation fee will be charged for the shortened number of days.
In the event of cancellation of a part of a group (15 or more persons), no cancellation fee will be charged if the cancellation is less than 10% of the number of guests (any fraction will be rounded up) 7 days prior to the stay (or the date of acceptance of the application if the application is accepted from that date).
This does not apply to cases where natural disasters make it physically difficult to arrive at the destination.
Usage Rules
In accordance with Article 10 of the Accommodation Agreement, MUNI KYOTO has established the following rules of use for the purpose of maintaining the dignity of the hotel and ensuring the comfort and safety of our guests during their stay. In the unlikely event that a guest fails to comply with these rules, we reserve the right to refuse the use of the room and other facilities in the hotel, in accordance with Article 7, Paragraph 1 of the Accommodation Agreement. Please understand that the hotel will not be held responsible for any accidents that may occur as a result of your failure to cooperate.
The following items are not permitted as they may disturb other guests.
Animals, birds (except assistance dogs for the disabled)
Explosives, volatile oils, and other flammable or combustible materials
Items that emit an offensive odor
Items that exceed the size and quantity of common sense
Guns, edged swords, and methamphetamines that are not authorized by law to be possessed
Please refrain from the following activities in our hotel that may disturb other guests
Visiting guests and in-room visitors. Please meet with visitors in the lobby.
Smoking outside of designated areas.
Actions that could cause a fire.
For purposes other than lodging, such as using the guest room or lobby as a party venue, office, or sales office.
To be used as
Advertising, distribution of promotional materials, sale or solicitation of goods.
Do not go outside the guest room wearing only a bathrobe or underwear.
Gambling and other activities that disturb public morals and cause inconvenience to others.
Any behavior that causes disgust or discomfort to other customers, or any disturbing behavior such as making noise.
Taking photographs in the Hotel for business purposes without the permission of the Hotel, or using photographs taken in the Hotel for business purposes.
Please use the safe in your room to store your cash and valuables during your stay. In the event of loss or theft, the hotel will not be responsible for any loss or theft. Please leave your room key at the reception when you leave the hotel. Please be sure to return it when you check out.
Requests Regarding Facilities and Items in the Museum
Do not use the product for any purpose other than its intended use.
Please refrain from uploading to the Internet (posting on websites, blogs, social networking services, etc.) or using for commercial purposes any still or moving images taken of the paintings installed in Restaurant Muni. The Hotel shall not be liable for any damages or disputes between guests and third parties, including legal action, arising from copyright infringement of the said paintings.
Do not move, alter, or modify the fixtures in the guest room without the permission of the hotel. Do not remove any fixtures from the room. Do not move or alter the fixtures in the room to another location.
The actual cost will be charged for any defacement, damage, or loss of equipment or fixtures inside or outside the hotel. No fires for heating or cooking are allowed in the hotel without the permission of the hotel. Cooking in the guest rooms is strictly prohibited.
Please do not place any items on the terrace that may detract from the appearance of the hotel. Do not drop any items on the terrace that may detract from the appearance of the hotel.
Do not leave personal belongings unattended outside of the guest room.
During your stay, please pay your bill each time the hotel presents it to you. We do not accept orders for food and beverages from outside the hotel (delivery to guest rooms).
